Terms of Service

Welcome to SparkQuest

These Terms of Service (“Terms”) govern your access to and use of SparkQuest, including our website, learning platform, learner experiences and related services.

SparkQuest is designed to help children learn, explore and build confidence through engaging, curriculum-aligned learning experiences.

Please read these Terms carefully. By creating an account or using SparkQuest, you agree to these Terms. If you create or manage an account for a child, you also accept the responsibilities described below.

Nothing in these Terms is intended to limit any rights you have under applicable South African law.

Who we are

SparkQuest is operated by:

SparkQuest provides digital educational services for learners and their families.

Additional statutory supplier information required for electronic transactions will be made available before paid subscriptions are offered.

Who may use SparkQuest

SparkQuest is designed primarily for school-age learners, with accounts and access managed through the appropriate Parent or guardian relationship.

A Parent or guardian creating or managing a SparkQuest family account must be legally capable of entering into an agreement with SparkQuest.

Children should not independently create or manage Parent accounts or purchase subscriptions.

Parents and guardians are responsible for:

  • providing accurate account information;
  • managing the learners associated with their account;
  • choosing the appropriate learner profile and grade;
  • managing learner access credentials;
  • keeping Parent account credentials secure; and
  • supervising their child's use of SparkQuest as appropriate for the child's age and circumstances.

Parent and learner access

SparkQuest separates Parent account access from learner access.

Parents use their own authenticated account to manage their family and learners.

Learners may access SparkQuest using approved learner-access methods such as a Spark PIN or Spark Pass, where available.

These access methods are intended only for the learner to whom they are assigned.

You must not:

  • share Parent account credentials with unauthorised people;
  • attempt to access another family's account;
  • use another learner's Spark PIN or Spark Pass without permission;
  • bypass SparkQuest access or security controls; or
  • interfere with mechanisms designed to protect learner accounts and sessions.

Parents should regenerate or revoke learner-access credentials if they believe those credentials have been compromised.

The SparkQuest learning service

SparkQuest provides digital learning experiences that may include:

  • CAPS-aligned subjects, terms and topics;
  • Quests and Discoveries;
  • quizzes and learning checks;
  • educational explanations and summaries;
  • progress and achievement features;
  • gamified learning experiences;
  • Explorer features;
  • curiosity-led learning experiences; and
  • other educational tools introduced over time.

Available content and features may differ by grade, subject, language, subscription plan or stage of the SparkQuest rollout.

We may improve, replace, reorganise or discontinue individual content items or features as the platform develops.

Where a material change affects a paid service, we will deal with it reasonably and in accordance with applicable consumer law.

Educational purpose

SparkQuest is a supplementary learning platform.

It is designed to support learning and complement formal education. It does not replace a school, teacher, educational professional or the official curriculum and assessment processes of a school or education authority.

We work to make SparkQuest educational content accurate, useful and appropriately aligned with the curriculum we reference. However, educational materials, curriculum interpretations and platform content may occasionally contain errors or require updating.

Parents, learners and educators should use appropriate judgement when relying on educational content.

SparkQuest does not guarantee particular marks, academic results, school admission, examination outcomes or educational performance.

Learning progress and achievements

SparkQuest may record learning activity such as progress, completed experiences, achievements, XP and related learning information.

Changing or cancelling a subscription does not, by itself, permanently delete learner progress.

Permanent deletion is a separate Parent-controlled process.

Some features or content may become unavailable when a subscription or entitlement changes, even where the underlying learning history remains associated with the learner.

Subscriptions and plans

SparkQuest may offer free and paid plans.

The features, learner limits, prices and billing terms applicable to a plan will be displayed before a Parent subscribes.

Paid SparkQuest subscriptions are not yet live.

Until paid subscriptions launch, any pricing or subscription information describing future paid functionality should not be interpreted as confirmation that online payment functionality is currently available.

Before paid subscriptions launch, SparkQuest will provide the transaction and payment information required for the applicable subscription.

Payments

When paid subscriptions become available, payment will be handled through a secure payment provider selected by SparkQuest.

The applicable:

  • subscription price;
  • billing frequency;
  • payment method;
  • renewal arrangements;
  • cancellation process; and
  • relevant refund or cooling-off information

will be presented before a Parent completes a paid subscription.

SparkQuest will not require a Parent to waive consumer rights that apply under South African law.

We will update these Terms when the final production payment and billing arrangements are implemented.

Cancellation of subscriptions

Cancelling a subscription and deleting personal information are different actions.

When paid subscriptions become available, Parents will be able to cancel in accordance with the cancellation terms presented with the applicable subscription and any rights provided by law.

Cancellation may affect access to paid content or features.

Cancellation does not, by itself:

  • permanently delete a learner;
  • permanently delete learning history; or
  • delete the Parent's SparkQuest family account.

Permanent deletion must be requested separately.

Nothing in these Terms limits a cancellation, cooling-off, refund or other consumer right that applies under South African law.

Archive and permanent deletion

SparkQuest provides different ways to manage learner information.

Archive is reversible. It removes a learner from active use while retaining the learner's information so that the Parent can restore the learner later.

Permanent learner deletion is irreversible once completed.

Family account deletion applies to the Parent account and its associated learners and currently includes a 30-day cooling-off period before permanent deletion is completed.

During that cooling-off period, the deletion request may be cancelled in accordance with the process described by SparkQuest. Once permanent purging has begun, the deletion cannot be cancelled.

Certain limited records may be retained or deidentified where reasonably necessary or required for legal, accounting, security or compliance purposes, as explained in our Privacy Policy.

Acceptable use

SparkQuest must be used lawfully and for its intended educational purposes.

You may not:

  • attempt to gain unauthorised access to SparkQuest or another user's information;
  • interfere with platform security or access controls;
  • probe, attack, overload or deliberately disrupt the service;
  • introduce malicious software or harmful code;
  • scrape or systematically extract SparkQuest content without permission;
  • copy or redistribute substantial parts of SparkQuest content without permission;
  • use automated tools to misuse the platform;
  • impersonate another person;
  • use SparkQuest to infringe another person's rights;
  • use the service for unlawful, fraudulent or harmful activity; or
  • assist another person to do any of these things.

Reasonable use of SparkQuest for personal learning, Parent support and legitimate educational purposes is encouraged.

Intellectual property

The SparkQuest platform and its original content, branding, design, learning experiences, software, graphics, text and other materials are owned by or licensed to SparkQuest, except where otherwise indicated.

“SparkQuest” and associated branding may not be used in a way that suggests endorsement, affiliation or ownership without permission.

A valid SparkQuest account gives you a limited, personal, non-exclusive, non-transferable right to access the service and its content for its intended educational use.

It does not transfer ownership of SparkQuest intellectual property to you.

You may not commercially reproduce, sell, sublicense or redistribute SparkQuest content without our written permission, except where applicable law permits otherwise.

AI-generated Explorer imagery

Certain SparkQuest features may use artificial intelligence to generate or assist with personalised Explorer imagery.

AI-generated content can vary and may occasionally produce unexpected or imperfect results.

Explorer imagery is intended as a creative platform feature and should not be treated as a factual representation of a person.

Users should avoid submitting unnecessary sensitive personal information when using features that involve AI processing.

SparkQuest does not use Explorer imagery to make legal or similarly significant decisions about a learner.

These documents should be read together with these Terms where relevant.

Communications

SparkQuest may send service-related communications necessary to operate an account or provide requested services.

Where a Parent separately chooses to receive optional communications, including eligible WhatsApp communications or direct marketing, those communications are subject to the Parent's applicable choices and rights.

Opting out of optional communications does not delete a SparkQuest account or learner.

Essential service or security communications may still be sent where necessary to provide or protect the service.

Availability and changes to SparkQuest

We aim to provide a reliable service, but no online service can be guaranteed to operate without interruption.

SparkQuest may occasionally be unavailable because of:

  • maintenance;
  • upgrades;
  • technical faults;
  • internet or infrastructure outages;
  • third-party service interruptions;
  • security incidents; or
  • circumstances reasonably outside our control.

We may make changes to SparkQuest as the platform develops.

Where practical, we will communicate material changes that significantly affect paid users or their use of the service.

Nothing in this section excludes rights or remedies that cannot lawfully be excluded.

Suspension and termination

SparkQuest may restrict or suspend access where reasonably necessary to:

  • protect a learner or another user;
  • investigate suspected unauthorised access;
  • respond to a security threat;
  • prevent fraud or misuse;
  • enforce these Terms;
  • comply with a legal obligation; or
  • protect SparkQuest, its users or its systems.

Where appropriate and reasonably possible, we will explain the reason or provide an opportunity to resolve the issue.

Serious, repeated or unlawful misuse may result in termination.

Any termination by SparkQuest will remain subject to applicable consumer law and any rights relating to paid services.

Third-party services

SparkQuest relies on selected service providers to operate parts of the platform.

These may include providers supporting areas such as:

  • hosting and database services;
  • authentication;
  • email;
  • communications;
  • AI-generated imagery; and
  • payment processing when paid subscriptions launch.

Third-party services may have their own terms and privacy practices.

Our use of service providers and handling of personal information is described further in our Privacy Policy.

Responsibility and limitation of liability

SparkQuest will provide its services with the level of care and quality required by applicable law.

Nothing in these Terms:

  • excludes or limits a right or remedy that cannot lawfully be excluded;
  • requires a consumer to waive rights provided by applicable consumer law; or
  • excludes liability where doing so would be unlawful.

To the extent permitted by law, SparkQuest is not responsible for loss caused solely by circumstances outside its reasonable control, misuse of the platform contrary to these Terms, or unauthorised access resulting from a user's failure to take reasonable care of credentials.

SparkQuest does not guarantee particular educational results or uninterrupted availability.

Any limitation or exclusion in these Terms must be interpreted subject to applicable South African law.

Changes to these Terms

SparkQuest may update these Terms as the platform, services or legal requirements change.

The Last updated date at the top identifies the current version.

For material changes affecting an existing paid subscription or a user's rights or obligations, we will provide appropriate notice where required and will not use a change to remove rights that cannot lawfully be excluded.

The version applicable to a particular transaction will be made available in a form that can be accessed and retained as required by applicable law.

Governing law

These Terms are governed by the laws of the Republic of South Africa.

Nothing in these Terms prevents a consumer from exercising rights or using dispute-resolution or enforcement mechanisms available under applicable South African consumer law.
